Remediation /  Returning to Class FAQs

30 Jan 09 – Issues relating to remediation and returning to class following the CUPE 3903 strike were discussed at a full meeting of the Joint Committee on Administration of the Collective Agreement (JCOAA) on Thursday, 29 January 2009. YUFA raised the following issues and concerns on members’ behalf. Outlined below are the results of our preliminary meeting. Discussions will be ongoing and we will let you know as additional information becomes available. In the interim, members are encouraged to contact YUFA with respect to any issues they may have (yufa@yorku.ca).

Leaves and Sabbaticals 01/09

Members who have approved leaves, including sabbatical, should proceed with their plans for leave. Those who voluntarily offer to remediate their courses will not receive additional compensation. Anyone with an unresolved leave is asked to contact YUFA.

Commitments / Research Plans 05/09

It is the Employer’s view that members will make reasonable efforts to postpone or reschedule commitments / research plans. Those members who have commitments / research plans which cannot be postponed or rescheduled should inform their Chairs / Deans as soon as possible.

Completion of Courses for Those on Leave

These will be handled on a case-by-case basis. It is the Employer’s position that these will be resolved with the assistance of colleagues and, where not possible with the hiring of replacements. If members are asked, and they choose to complete, the course of another faculty member who will be absent following the CUPE 3903 strike due to leave (notwithstanding Article 19.04; short-term leaves of up to one month) or retirement, the Employer proposes that these members will be paid at the YUFA Overload Rate. The pro-rated portion will normally be for ¼ of the Fall term course(s).

Retirees

Members who retired 1 December 2008, and have not been paid for the completion of Fall term courses, who choose to return to complete their course(s) will receive compensation under Article 14.02.

Tenure & Promotion

It is the Employer’s position that files will be dealt with on a case-by-case basis. The parties will continue to discuss the issues pertaining to Tenure & Promotion as affected by the teaching interruption.

Summer School

Summer school will run late but will be comprised of all of its terms.

Making Coursework Available Outside of Class

It is up to individual faculty members to determine how they make material available to students outside of class.

Grades Turnaround

Information with respect to the turnaround of grades will be forthcoming from Senate Executive and the Registrar.

On-Load Summer Teaching

On-load summer teaching will be offered under normal practices and conditions.

Parking

Fall term parking permits will be extended until the new end of the Fall term.

Staff Support

It is expected that the relevant units will ensure that the required staff support is available. The principle is that there should not be fewer staff available.

Housing

YUFA requested, and the Employer agreed, to explore the possibility of on-campus housing for faculty who find themselves requiring housing until to the new end of the Fall term.

Conferences

It is anticipated that conferences will be handled in the same way they are during the year and that faculty will ensure that the appropriate arrangements are in place. YUFA has requested that additional proctors be provided for the exam period at the end of the Winter term.
