Interest arbitration established by Article 13.05 of the 1979-81 Collective Agreement

The parties agree to establish within thirty (30) days of the signing of this Agreement a tripartite committee of the two parties to this Agreement and the Senate of York University with each of those three bodies having a single voice, to examine the following:

If all three parties (i.e. the Association, the Employer, the Senate) are in agreement with respect to any item ... above, it will be incorporated in the Report of the Senate Committee on Tenure and Promotions applicable to the bargaining unit. Any proposals which have not been agreed to by all three parties by 1 September 1980 will be submitted, at the request of any one of the three parties to final and binding arbitration by an arbitrator to be chosen jointly by the Presidents of the CAUT and the Association of Universities and Colleges of Canada. Any proposal approved by the arbitrator will be incorporated in the Report of the Senate Committee on Tenure and Promotions applicable to the bargaining unit. All three of the parties shall have standing before the arbitrator. The parties to this Agreement (i.e. the Association and the Board) agree to share the costs of such arbitration.

The jurisdiction of the tripartite committee shall be limited to [the listed aspects of the tenure & promotions process], and it will cease to exist on 1 September 1980.
