Accommodations for Faculty in Precandidacy and Candidacy whose Files have been Negatively Affected by the CUPE 3903 Strike

The principal element of the accommodations is the provision for a stopout year. For faculty members currently in Candidacy 2 or 3 and whose files have not been fully assembled by their local unit, the stopout will be granted upon the faculty member’s request, in accordance with the motion on Tenure and Promotion accommodation passed by Senate at its January meeting. For other faculty members to whom the accommodations apply, the provision of a stopout year is/will be available on an as-needed basis.

The pool of faculty members to whom the provision of a stopout year applies on an as-needed basis consists of members currently in Precandidacy 2 or 3 and members currently in Candidacy 1, 2 or 3.

For faculty members belonging to YUFA, the primary mechanism by which a stopout year may be granted on an as-needed basis is the Dispute Resolution Committee (DRC), made up of representatives of YUFA and of the administration. Faculty members desiring a stopout year may invoke this mechanism by writing a letter to the DRC explaining the impact of the strike on their file. In most instances, the trigger for requests for a stopout year will be a negative decision, including a decision of delay, by a tenure and promotion committee.

The specific details of the accommodations for the different levels of Precandidacy and Candidacy are outlined below.

Precandidacy 1: No accommodation.

Precandidacy 2: The stopout provision will apply to this group in 2001-2002, when they will be in Precandidacy 3. They will be eligible to petition the DRC for a stopout year if their file is not successfully advanced to Candidacy.

Precandidacy 3: No accommodation appears to be necessary at this point [right now], as there have been no reports of files that have been unsuccessful in the advancement to Candidacy. The stopout provision will be available to this group in 2002-2003, when they have reached Candidacy 2. At this point, they may petition the DRC for a stopout year if they receive a negative decision including a decision of delay on their file by one of the tenure and promotion committees. No specific accommodation is specified for this group in their Candidacy 1 year (2001-2002) because it is assumed that individuals in this group will opt to put themselves forward for tenure and promotion in Candidacy 1 only if they are confident about the strength of their file. Further, if their file receives a delay decision in Candidacy 1, then they will go forward for tenure and promotion the next year in Candidacy 2 without a stopout provision.

Candidacy 1: Faculty members in this group who have put themselves forward for tenure and promotion in the current year have the stopout provision provided by the Senate motion passed in January. Specifically, they will be eligible to repeat their Candidacy 1 year in 2001-2002 upon request if assembly of their file is not yet complete. Faculty members in Candidacy 1 who have not put themselves forward for tenure and promotion in the current year will have a stopout provision available to them at two separate points:

1) “Early warning” accommodation. Under this accommodation a candidate may declare 2001-2002 to be a stopout year with the agreement of the unit Chair (or Dean in non-departmentalized Faculties) and file preparation committee prior to the completion of the candidate’s file. If an individual currently in Candidacy 1 concludes that a stopout year is warranted prior to the completion of his or her file but is in disagreement with the Chair/Dean and/or the file preparation committee about the need for a stopout, then he or she may petition the DRC to count 2001-2002 as a stopout year. The early warning provision should be exercised by July 1, 2001.

2) Standard stopout accommodation. If the early warning provision is not exercised and the candidate’s file goes forward for consideration in 2001-2002, the candidate may petition the DRC for a stopout year if he or she receives a negative decision including a decision of delay on the file from one of the tenure and promotion committees.

Candidacy 2 and 3: As indicated above, individuals in Candidacy 2 and 3 whose files have not yet been fully assembled by their local unit are eligible to repeat their Candidacy 2 or 3 year in 2001-2002 on request under the Senate motion passed in January. An additional accommodation is available to individuals in Candidacy 2 and 3 whose files are assembled. Faculty in this group may declare 2000-2001 as a stopout year and repeat their current Candidacy level in 2001-2002 in the event that one of the tenure and promotion committees considering their file requests additional information which cannot be provided because of the strike.

Finally, a stopout provision will also be provided to faculty currently in Candidacy 2 who receive a final decision of delay and go forward for tenure and promotion in 2001-2002 in Candidacy 3. Individuals in this group will be eligible to petition the DRC to count 2001-2002 as a stopout year if they receive a negative decision including a decision of delay on their Candidacy 3 file from one of the tenure and promotion committees.
