Contractually Limited AppointmentsWhat is a CLA?CLAs (Contractually Limited Appointments) are appointments for specified periods of time, between five months and three years. CLAs are usually appointed to replace tenure-stream employees on leave, or to fill specific teaching or research needs for which the Employer, for budgetary or academic reasons, doesn’t want to commit a tenure-stream position. CLAs can also be used to bring distinguished visitors or individuals with specialized skills to York. How many CLAs are there and how have the numbers been changing?In 2009/2010 there are 45 CLAs working at York.
What are the differences between CLAs and other YUFA members?Contractually Limited Appointments carry no implication of renewal or continuation beyond the specified term and aren't eligible for tenure. Otherwise, the Collective Agreement does not distinguish between CLAs’ and other YUFA members’ professional responsibilities, except for teaching and service in some departments. How is a CLA different from a ‘contract faculty’ position, a ‘conversion’, and a ‘Special Renewable Contract’?‘Contract faculty’ are CUPE 3903 members, hired on a course-by-course basis. Conversions are special appointments to tenure-track positions in YUFA from the pool of eligible contract faculty. ‘Special Renewable Contracts’ are five- to 13-year appointments in YUFA available to long-service contract faculty. What limits are there on the extension of my contract?Normally, CLAs are no longer than three years. In unusual circumstances, these appointments can be extended to a maximum of five years. This applies only to CLAs filling specific teaching or research needs for which the Employer, for budgetary or academic reasons, doesn’t want to commit a tenure-stream position. By when will I hear if my contract will be extended?The deadlines for hearing from your Dean / Principal / University Librarian are set out in clauses 12.29 and 12.30. If your CLA is for a year or more and the Employer misses the deadline, you're entitled automatically to an additional year of appointment. What are the chances of a CLA receiving a tenure-stream appointment at York?Of the 100 people who were CLAs in 2007/2008 and 2008/2009, 12 held tenure-stream appointments at York in 2009/2010. Clause 12.12 states that CLAs applying for tenure-stream positions will 'be considered in the normal way along with all other candidates for the position'. CLAs moving to tenured / continuing appointments will be credited with up to four years of service toward sabbatical leave or consideration for tenure. For what salary increases am I eligible?CLAs are, in principle, eligible for all YUFA-negotiated salary increases. However, many Contractually Limited Appointments are too brief to get them. Specifically, your CLA must begin by 1 September and continue past the following 30 June for you to receive the Progress-through-the-Ranks (PTR) and 'across-the-board' salary increases, which are paid on 1 May. Eligibility for merit bonuses for the previous year’s work operates differently. The Collective Agreement stipulates that you're eligible to apply if your CLA began by 1 September of the previous year and is expected to continue past the upcoming 30 June. For example, if you hold a three-year CLA that began on 1 July 2009, the first merit pay exercise for which you’d be eligible would be in Fall 2010 (for your 2009/10 work). But, if you held a two-year CLA starting on the same date, you wouldn’t be eligible to apply in the Fall 2010 exercise. Do I get benefits all year and vacation pay if my CLA is for less than 12 months?Unfortunately, your benefits last only as long as your appointment. If your CLA is for one year or more, you get one month of paid vacation annually. If your CLA is for less than one year, your vacation pay is pro-rated. For example, if your CLA is for five months, you get 5 ÷ 12 of a month's salary as your vacation pay.
